Welcome to QiBelly. These Terms and Conditions outline the rules and regulations for the use of our services and participation in our SMS communication program. By signing up for our fitness programs or SMS campaigns, you agree to comply with these terms. Please read them carefully.
In addition, your access to and use of this Site is subject to legally binding terms and conditions, which you accept and agree to by accessing this Site.
The following terms and conditions (“Terms and Conditions”) form a binding agreement (this “Agreement”) between you and QiBelly operating out of the Province of Ontario (“QiBelly”). QiBelly may modify, amend, supplement and replace these Terms and Conditions at any time without providing you with advance notice. Your continued use of this Site after any change means you have accepted the changed Terms and Conditions.
1.1 Communications Program
As part of our services, QiBelly offers an SMS program and email notifications and newsletters to keep you informed and motivated. By opting in, you consent to receive text messages and/or email notifications and newsletters related to our services.
1.2 SMS Program
1.2.1 Message Frequency
You can expect to receive 4-6 messages per week depending on your usage and attendance, including but not limited to:
- Class schedule updates
- Class and Event reminders
- Exclusive promotions and offers
- Dojo closures and updates
1.2.2 Product Description
QiBelly SMS program is designed to keep you updated and engaged with personalized fitness content, class information, and exclusive offers.
1.2.3 Customer Care
If you have any questions or need support, contact us at www.qibelly.com/contact or reply “HELP” to any of our messages for assistance.
1.2.4 Opt-out Information:
- To opt-out of the SMS program at any time, reply “STOP” to a QiBelly text. After opting out, you will no longer receive text messages from us.
- For single-message programs, you will receive only one message upon opt-in, and no further action is required unless you wish to opt out for future communication.
1.2.5 Message and Data Rates
Message and data rates may apply depending on your mobile carrier and plan. Please check with your provider for details.
1.2.6 Associated Costs
Participation in the SMS program is free from our end, but you are responsible for any charges from your mobile carrier, including text message fees and data rates.
1.3 Email Notifications and Newsletters
You can opt not to receive these emails from us by either clicking “unsubscribe” at the bottom of the email when you receive it, customizing the email notification settings in your account settings, or by sending an email that includes your email address and a request that you not receive our emails.
1.4 Children
Clients under the age of 18 are welcome if accompanied by a parent or legal guardian, who will be asked to give signed consent for treatment. They will also be asked to remain present for the duration of the agreed treatment.

2.2 How We Use Your Information
Your Personal Information will be used to provide you with promotional and informative materials and offers and deliver the products and services you can purchase or subscribe to from the Site.
We use your personal information for the following purposes:
2.2.1 Providing Services
To deliver our QiBelly fitness and wellness services, including personalized workouts, training plans, healing treatments, appointment bookings, workshop bookings and class bookings.
2.2.2 Communication
To send you important information about our services, updates, promotions, and to respond to your inquiries.
2.2.3 Payment Processing
To process payments and maintain financial records. Your credit card information will not be kept by QiBelly but instead by one of the third parties listed in section 2.1.7 (above);
2.2.4 Marketing
To send you information about our services, promotions, and offers via email or text. You can opt out of this marketing at any time by replying with the word STOP to SMS text messages or using the “unsubscribe” link in emails or contacting Paul Lara directly. More information on SMS and email newsletter program in section 1.16.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Message and data rates may apply and you may reply STOP to opt-out of messaging; reply HELP for additional messaging help. Message frequency may vary based on usage.
2.3 Data Security
We take data security seriously and implement reasonable technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, and destruction.
Walla, our primary studio third-party software provider, ensures that handle payments and client information uphold industry standards including PCI compliance for safe credit card payment, a high standard of credit card protection by using Stripe. In addition, they meet SOC 2 data processing and storage standards in order to ensure data safety for our users. While they are a United States of America company, we have ensured they have data protection and policy addenda to protect Canadians.
2.4 Data Sharing
We do not sell or share your personal information with third parties without your explicit consent, except for the following situations:

We may share your information with trusted third-party service providers who assist us in delivering our services.
We have ensured that if we discontinue using these services, especially with Walla, your information will remain confidential and will be deleted upon request.
